Automotive Mechanic Leader Proposed for Removal, Reinstated to Former Duties

A Laredo Sector Automotive Mechanic Leader (Leader) was proposed for removal from his position and from Federal Service for two charges of misconduct leveled against him. The charges were 1.) Improper Use of Signature of another on an Official Form, supported by one specification; and 2.) Lack of Candor, supported by one specification.

The allegations were that the Joint Intake Center (JIC) received an email from a U.S. Customs and Border Protection (CBP) Automotive Mechanic Supervisor (Supervisor) stating that it was discovered that the Leader had forged the name of a mechanic on over 70 Fleet Card Transactions, DHS Form 1502 (1502’s). An internal investigation was initiated, and witnesses were questioned as to their knowledge of the allegations. The Leader was then called in and questioned about the forms bearing the mechanic’s signature. The Leader initially denied having signed the forms, however, on further questioning admitted that he had forged the signature on the 1502’s.

Thereafter, a Proposal Letter was served upon the Leader informing him of his proposed removal from his position and from Federal Service Based on two charges of misconduct.

The Leader then hired Lawman Legal attorney Roberto M. Garcia based out of Edinburg, Texas, to represent him in the disciplinary administrative process of written and oral replies to the charges. Mr. Garcia investigated and researched the facts, the policies and the procedures. He then prepared and filed a 35-page written reply to the charges and the proposed removal penalty. He also appeared before the Deciding Official in Laredo, Texas where he further presented a strong factual and legal defense on behalf of the Leader.

Mr. Garcia’s legal representation was successful as it resulted in the Deciding Official sustaining Charge 1 and not sustaining Charge 2. The penalty was reduced to a fiveday suspension and the Leader was reinstated to his former position and duties. The Leader was able to continue with his federal career spanning more than 20 years as a loyal, faithful and dedicated federal employee.
